1. Acceptance of These Terms
These Terms of Use (the "Terms") are an agreement between you and AngelGate Solutions ("we," "us") for our iPhone games: Sudoku Bloom, Mirror Blocks, Word Bloom, Number Merge, Matchly: Memory Cards, Pocket Planets. By downloading or playing a game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the games.
Apple's standard Licensed Application End User License Agreement also applies. If it conflicts with these Terms on a matter it covers (such as the license), Apple's agreement controls. We, not Apple, are responsible for the games and their content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
2. License and Acceptable Use
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the games on Apple devices you own or control, for personal non-commercial use. You agree not to: copy, modify, reverse engineer or resell a game; use cheats, bots, scripts, memory editors, modified clients or exploits; tamper with scores, currency, leaderboards, ads or purchases; interfere with our servers; or use the games unlawfully. We may reset, remove or suspend scores, currency or accounts obtained through abuse.
3. Accounts and Progress
Accounts are optional. You are responsible for your Apple ID and your device. Progress saved only on your device can be lost if you delete the app or lose the device. Cloud sync is provided as a convenience, not as a guaranteed backup.
4. Virtual Currency and Items
In-game currency (such as seeds, shards or stardust), boosters, themes and similar items are a limited license to use features inside the game. They have no cash value, cannot be sold, traded or transferred, and are not redeemable for money. We may balance, change or remove items and prices. When you delete your account or we end a game, unused currency and items are lost, except where the law says otherwise.
5. Purchases and Subscriptions
Purchases are made through the App Store and billed by Apple. Prices are shown in the app and may vary by region and taxes. All sales of consumable currency are final except where the law or Apple's policies give you a right to a refund; request refunds from Apple (reportaproblem.apple.com).
Plus subscription. Plus is an auto-renewing subscription (monthly or yearly) that removes ads and adds the perks shown in the app. Payment is charged to your Apple ID at confirmation of purchase. It renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in iOS Settings > your name > Subscriptions. Any unused part of a free trial is forfeited when you buy a subscription. Deleting the app does not cancel it.
6. Advertising
Free games show ads from third parties. We are not responsible for the content of ads or for third-party sites and products they link to. Rewarded videos are optional and the reward is granted only after you complete them. Do not click ads fraudulently or ask others to.
7. Third-Party Services
The games use Apple (App Store, Game Center, Sign in with Apple, WeatherKit), Google Firebase and Google AdMob. Their terms and availability are outside our control, and weather and similar information is shown for fun, not for safety decisions. Game Center leaderboards are subject to Apple's terms.
8. Age
The games are not directed to children under 13. If you are under the age of majority where you live, use them with a parent or guardian's permission, who is responsible for any purchases.
9. Intellectual Property
The games, their art, music, sounds, code and trademarks belong to AngelGate Solutions or its licensors. Except for the license above, you receive no rights in them. Feedback you send us may be used without obligation to you.
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. If the games fail to conform to any applicable warranty, you may tell Apple, who will refund the purchase price of a paid app; to the maximum extent permitted by law Apple has no other warranty obligation. Other claims about the games are ours to handle, not Apple's.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROGRESS, SCORES OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A GAME WILL NOT EXCEED THE AMOUNT YOU PAID US THROUGH THE APP STORE FOR THAT GAME IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING. Some places do not allow these limits, so they apply only as far as the law permits, and nothing here limits liability that cannot be limited by law.
12. Changes, Suspension and Ending
We may update, suspend or stop a game or feature, or end your access for breaking these Terms. You may stop at any time by deleting the app and, if you wish, your account (see the Privacy Policy). Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive.
13. Governing Law and Venue
These Terms are governed by the laws of the United States and, to the extent applicable, the state in which AngelGate Solutions is established, without regard to conflict-of-laws rules. Disputes shall be brought exclusively in the state or federal courts located there, except that you may also rely on mandatory consumer-protection laws of the place you live.
14. Changes to These Terms
We may update these Terms. We will change the date above and tell you in the app of material changes. Continuing to play after changes take effect means you accept them.
