1. Acceptance of These Terms
These Terms of Use (the "Terms") are an agreement between you and AngelGate Solutions ("we," "us") for the Twilit iPhone app, its widgets and its Live Activity. By downloading or using Twilit you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Twilit.
Apple's standard Licensed Application End User License Agreement also applies. If it conflicts with these Terms on a matter it covers (such as the license), Apple's agreement controls. We, not Apple, are responsible for Twilit and its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Twilit on Apple devices you own or control, for personal non-commercial use.
3. Acceptable Use
You agree not to: copy, modify, reverse engineer, resell or redistribute Twilit or its art; bypass or tamper with purchases, Plus or the free-plan limits; use Twilit to store or display unlawful content or photos you have no right to use; interfere with Apple's services or ours; or use Twilit unlawfully. You are responsible for the photos and text you put into your Frames and widgets.
4. Purchases and Subscriptions
Purchases are made through the App Store and billed by Apple. Prices are shown in the app and vary by region and taxes. Refunds are handled by Apple (reportaproblem.apple.com).
Twilit Plus is an auto-renewing subscription, offered monthly and yearly, that unlocks the perks listed in the app. New subscribers may get a 7-day free trial; Apple shows the offer that applies to you before you confirm. Payment is charged to your Apple ID at confirmation of purchase (or when a trial ends). The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in iOS Settings > your name > Subscriptions. Any unused part of a free trial is forfeited when you buy a subscription. Deleting the app does not cancel it.
Packs. Seasonal theme packs are one-time purchases that unlock a theme for your Apple ID. Restore Purchases in Settings brings back what your Apple ID already owns.
The free plan has limits (for example one Frame and six photos shown per Frame). We may change what is free and what needs Plus, but we will not remove what you bought in a pack.
5. Your Content
Your photos and text stay yours. You give us no license to them because they stay on your iPhone and are not sent to us. You promise you have the right to use them in Twilit.
6. Third-Party Services and Brands
Twilit uses Apple services (StoreKit, PhotoKit, EventKit, Contacts, Maps place names, Sign in with Apple for staff), Open-Meteo for weather, and Google Firebase for the staff sign-in. Their availability and terms are outside our control. Weather is shown for convenience, not for safety decisions.
Original characters, no affiliation. Twilit's themes, pets and characters are original works of AngelGate Solutions. Twilit is not affiliated with, endorsed by or sponsored by Apple or any third-party app or service. Some widgets and shortcuts open other apps (for example Photos, Music or Messages) through those apps' public links. Names of other apps and services belong to their owners and are used only to say what a shortcut opens.
7. Age
Twilit is not directed to children under 13. If you are under the age of majority where you live, use it with a parent or guardian's permission, who is responsible for any purchases.
8. Intellectual Property
Twilit, its themes, art, pets, sounds, code and trademarks belong to AngelGate Solutions or its licensors. Except for the license above, you receive no rights in them. Feedback you send us may be used without obligation to you.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWILIT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Widgets are refreshed on a schedule iOS controls, so timing, weather and photo rotation can be late. If Twilit fails to conform to any applicable warranty, you may tell Apple, who will refund the purchase price of a paid app; to the maximum extent permitted by law Apple has no other warranty obligation. Other claims about Twilit are ours to handle, not Apple's.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST SETTINGS, FRAMES OR PHOTOS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO TWILIT WILL NOT EXCEED THE AMOUNT YOU PAID US THROUGH THE APP STORE FOR TWILIT IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING. Some places do not allow these limits, so they apply only as far as the law permits, and nothing here limits liability that cannot be limited by law.
11. Changes, Suspension and Ending
We may update, suspend or stop Twilit or a feature. You may stop at any time by deleting the app, which also deletes your data on the device (see the Privacy Policy). Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive.
12. Governing Law and Venue
These Terms are governed by the laws of the United States and, to the extent applicable, the state in which AngelGate Solutions is established, without regard to conflict-of-laws rules. Disputes shall be brought exclusively in the state or federal courts located there, except that you may also rely on mandatory consumer-protection laws of the place you live.
13. Changes to These Terms
We may update these Terms. We will change the date above and tell you in the app of material changes. Continuing to use Twilit after changes take effect means you accept them.
